Probate is the legal process through which a deceased person’s estate is administered and distributed. It involves validating the deceased’s will (if one exists), identifying and appraising the assets of the estate, paying off any debts or taxes, and distributing the remaining assets to the beneficiaries or heirs according to the will or, if no will exists, according to state laws (intestate succession).
The probate process typically includes the following steps:
- Filing the will: The executor (if named in the will) or an interested party files the will with the local probate court to begin the process.
- Validating the will: The court ensures that the will is legally valid, which may involve verifying signatures, witnesses, and the mental capacity of the deceased at the time of the will’s creation.
- Appointing an executor: If the deceased person named an executor, the court formally appoints that individual. If there was no will, or if the named executor is unable or unwilling to serve, the court will appoint an administrator.
- Inventorying assets: The executor or administrator lists all assets of the deceased, including real estate, bank accounts, investments, and personal property.
- Paying debts and taxes: Any outstanding debts or taxes owed by the deceased must be settled before distributing assets to heirs. This may include funeral expenses, medical bills, and state or federal taxes.
- Distributing assets: Once debts and taxes are paid, the remaining assets are distributed according to the instructions in the will or, if there is no will, according to the laws of the state where the deceased lived.
Probate can take several months or even years, depending on the complexity of the estate and the court’s caseload. Some assets, like those held in a living trust, may avoid probate entirely.
